PARTICIPANTS MUST AGREE TO THE FOLLOWING TERMS & CONDITIONS

This website is owned and operated by Aqualand Of The Free LLC. These Terms set forth the terms and conditions under which you may use our website and services as offered by us. This website offers visitors information and sign up capability for our waterman, surf, and water polo classes and camps. By accessing or using the website for our services, you approve that you have read, understood, and agree to be bound by these Terms.

When signing up for any class(es) or camp(s), you agree that: (i) you are responsible for reading the full listing before making a commitment to sign up: (ii) you enter into a legally binding contract to purchase our service when you commit to buy an item and you complete the check-out payment process.

RELEASE OF LIABILITY FOR ADULT AND MINOR PARTICIPANTS

IN CONSIDERATION OF myself or my child/ward being allowed to participate in any way in the Waterman Camp, Surf Camp, Water Polo and all related Aqualand events and activities, the acceptance of these terms acknowledges, appreciates, and agrees that:

The risks of injury to myself or my child from the activities involved in these programs are significant, including the potential for permanent disability and death, and while particular rules, equipment, and personal discipline may reduce these risks, the risks of serious injury and illness do exist; and FOR MYSELF, SPOUSE, AND CHILD, I KNOWINGLY AND FREELY ASSUME ALL SUCH RISKS, both known and unknown, EVEN IF ARISING FROM THE NEGLIGENCE OF THE RELEASES or others, and assume full responsibility for myself or my child’s participation; and willingly agree to comply with the program’s stated and customary terms and conditions for participation. If I observe any unusual significant concern in myself or my child’s readiness for participation and/or in the program itself, I will remove my child from the participation and bring such attention of the nearest official immediately; I myself, my spouse, my child, and on behalf of my/our heirs, assigns, personal representatives and next of kin, HEREBY RELEASE AND HOLD HARMLESS Aqualand Of The Free; its directors, officers, officials, agents, employees, volunteers, interns, other participants, sponsoring agencies, sponsors, advertisers, and if applicable, owners and lessors of premises used to conduct the event (“Releasees”), WITH RESPECT TO ANY AND ALL INJURY, ILLNESS, DISABILITY, DEATH, or loss or damage to person or property incident to my child’s involvement or participation in these programs, WHETHER ARISING FROM THE NEGLIGENCE OF THE RELEASEES OR OTHERWISE, to the fullest extent permitted by law.

I, for myself, my spouse, my child, and on behalf of my/our heirs, assigns, personal representatives and next of kin, HEREBY INDEMNIFY AND HOLD HARMLESS all the above Releasees from any and all liabilities incident to my involvement or participation in these programs, EVEN IF ARISING FROM THEIR NEGLIGENCE, to the fullest extent permitted by law.

I, the participant or parent/guardian of the participant, assert that I have explained to my child/ward: the risks of the activity, his/her responsibilities for adhering to the rules and regulations, and that my child/ward understands this agreement.

I, FOR MYSELF, MY SPOUSE, AND CHILD/WARD, HAVE READ THIS RELEASE OF LIABILITY AND ASSUMPTION OF RISK AGREEMENT, FULLY UNDERSTAND ITS TERMS, UNDERSTAND THAT WE HAVE GIVEN UP SUBSTANTIAL RIGHTS BY SIGNING IT, AND SIGN IT FREELY AND VOLUNTARILY WITHOUT ANY INDUCEMENT.

CANCELLATION POLICY FOR BAY CAMP

Please take a moment to review our updated cancellation policy FOR BAY CAMP. We are a small family business and we do our best to keep our camps affordable for families. This means we do a lot of the jobs, including behind the computer admin & registration. We care a lot about your kids and hope to spend as much time with them as possible! A reasonable cancellation policy ensures that you respect our time and that we can pay staff and run camp effectively. Bay Camp is non-refundable unless cancelled one week in advance. Upon this cancellation, you will be refunded 75% of the amount minus the 25% deposit. Please register with some level of certainty in your scheduling, or with the understanding that you are putting down a 25% non-refundable deposit.

REFUNDS

For weekly Waterman Summer Camps (Not Surf via Seal Beach), refunds minus a 25% non refundable deposit will be granted for cancellations made by 6pm on the Monday one week prior to the start of camp the following Monday. This will allow us time to rebook another camper. Refunds will not be issued for “no shows”. Refunds must be requested by emailing info@aqualandofthefree.com. If a refund request is made in time, Aqualand will offer a refund of the 75% based upon the original payment method. In addition, please note the following: (i) days missed in weekly and monthly class sessions will not be refunded; and (ii) make-up classes will be up to the digression of Aqualand.

CODE OF CONDUCT AND REMOVAL POLICIES FOR CAMPERS

Campers and class participants must adhere to behavioral expectations laid out by Aqualand staff which include but are not limited to:

  1. Respectful communication with staff

  2. Zero use of profanity

  3. Zero physical violence or unwanted physical contact with other campers - keep hands to themselves

  4. No throwing or kicking of sand

  5. Campers must stay with the group at all times

  6. Campers must participate in all activities 

  7. Campers must respond to verbal instructions and directions from staff i.e. it's time to get out of the water, do not go in the water etc.

  8. Campers must follow all direction given that is specific to the dynamic conditions and safety of watermen activities, watercraft safety and bay/ocean activities.

Campers who are repeatedly unable to adhere to our code of conduct will participate in a parent and camper meeting with Aqualand staff.

Campers who continue to be unable to comply with our code of conduct will be removed from the remainder of camp at the discretion of Aqualand.​

Aqualand reserves the right to remove any camper at any time and at our discretion.

Attending Aqualand is a privilege, not a right.

 

ILLNESS AND COVID 19



By signing up for Aqualand Of The Free Services, I attest that: Myself or My Child, “The Participant” is not experiencing any symptom of illness such as cough, shortness of breath or difficulty breathing, fever, chills, repeated shaking with chills, muscle pain, headache, sore throat, or new loss of taste or smell.


Myself or My Child, “The Participant” has not been diagnosed with Coronavirus/Covid-19 and not yet cleared as non contagious by state or local public health authorities.

PRICING 



The prices we charge for using our services / for our products are listed on the website. We reserve the right to change our prices for products displayed at any time, and to correct pricing errors that may inadvertently occur. Additional information about pricing and sales tax is available on the payments page. 

The fee for the services and any other charges you may incur in connection with your use of the service, such as taxes and possible transaction fees, will be charged to your selected payment method.

 

USAGE OF SITE AND SERVICES

You agree to indemnify and hold Aqualand Of The Free harmless from any demands, loss, liability, claims or expenses (including attorneys’ fees), made against them by any third party due to, or arising out of, or in connection with your use of the website or any of the services offered on the website.

To the maximum extent permitted by applicable law, Aqualand Of The Free assumes no liability or responsibility for any (i) errors, mistakes, or inaccuracies of content; (ii) personal injury or property damage, of any nature whatsoever, resulting from your access to or use of our service; and (iii) any unauthorized access to or use of our secure servers and/or any and all personal information stored therein.

SOCIAL MEDIA

Please request via email if you do not wish for your child to be included in our social media.

You agree to receive from time to time promotional messages and materials from us, by mail, email or any other contact form you may provide us with (including your phone number for calls or text messages). If you don't want to receive such promotional materials or notices – please just notify us at any time via info@aqualandofthefree.com.

 

CHANGES TO SERVICE/OFFERINGS



We may, without prior notice, change the services; stop providing the services or any features of the services we offer; or create limits for the services. We may permanently or temporarily terminate or suspend access to the services without notice and liability for any reason, or for no reason.

NON-SECTARIAN

Aqualand’s programs shall remain non-sectarian and open to all regardless of religion.
